Please read this page thoroughly before using this service.
VIP-HOTSPOT is the trading name of Melanterit SL and for the purposes of this contract Melanterit assumes the rights of VIP-HOTSPOT SL
Our contract with you:
1. The “Service”
The service is a connection to the VIP network and grants you access to a range of services and products offered by VIP-HOTSPOT.
2- Our commitment
We are committed to providing the service to you using all of the reasonable skills and care of a competent Wireless Internet Service Provider.
3- Ensuring that the service is secure
3.1 Any usernames and passwords issued to you are for your secure use of the service. You mustensure that they are kept confidential, secure and are used in accordance with all relevant instructions.
3.2 If we think there is a breach of security or misuse of the service we may:
(a) Change your username or password and notify you. and/or
(b) Suspend the username and password or access to the service.
3.3 If you think that any username or password issued to you has become known by someone notauthorised to use it, or if any password is being, or is likely to be used in an unauthorised way, you must inform VIP-HOTSPOT immediately.
4- Things we may have to do
4.1 We may need to temporarily suspend the service for operational reasons e.g. for repairs, plannedmaintenance or upgrades. We will restore the service as soon as possible after any suspension.
4.2 We may have to alter code or access numbers or technical specifications associated with theservice for operational reasons.
4.3 We may give you instructions about how to use our service, in order to ensure the quality of theservice we provide to you and to other customers, you must therefore agree to observe these instructions.
5- Repairing faults in the service
5.1 Although we attempt to provide you with the best possible service, we cannot guarantee that theservice will never be fault free. However, we will correct all reported faults as soon as reasonably possible.
5.2 We reserve the right to allow 72 hours for our engineers to resolve any issues.
5.3 If there is a fault with your service or you forget a password you must contact VIP-HOTSPOT in thefirst instance.
6- Payment of charges
6.1 You agree to pay the charges for the services and any other charges that are set out in the price list.This price list constitutes part of this contract.
6.2 When you register for the service or any services provided by VIP-HOTSPOT we will ask you to pay in advance before continuing.
7- Use of the service
7.1 Unless otherwise authorised by us in writing, you may only use a single user account solely for your use of the service.
7.2 May not reproduce, duplicate, copy, sell, provision, resell, rent, lend, pledge, directly or indirectly transfer, distribute or exploit any portion of the Service without prior written consent. You will not use the Service in a manner prohibited by any law or regulation, and will abide by our Policies.
7.3 You may not use the Service, or allow the Service to be used, for any abusive purpose or in anyway that damages VIP-HOTSPOT’s property or interferes with or disrupts VIP-HOTSPOT’s network or other users or subscribers.
7.4 In addition, you agree not to use or attempt to use the Service, the VIP-HOTSPOT network orwebsite, or your device for any fraudulent, unlawful, harassing or abusive purpose, or so as to damage or cause risk to our business, reputation, employees, subscribers, facilities, or to any person. Improper uses include, but are not limited to:
(a) Violating any applicable law or regulation; (b) Posting or transmitting content you do not have the right to post or transmit; (c) Posting or transmitting content that infringes a third party's trademark, patent, trade secret, copyright, publicity, privacy, or other right; (d) Posting or transmitting content that is unlawful, untrue, stalking, harassing, libelous, defamatory, abusive, tortious, threatening, obscene, hateful, abusive, harmful or otherwise objectionable as determined in our sole discretion; (e) Attempting to intercept, collect or store data about third parties without their knowledge or consent; (f) Deleting, tampering with or revising any material posted by any other person or entity; (g) Accessing, tampering with or using non-public areas of the Service or any VIP-HOTSPOT website or VIP-HOTSPOT’s computer systems and network; (h) Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures; (i) Attempting to access or search the Service or any VIP-HOTSPOT network or website with any engine, software, tool, agent, device or mechanism other than the software and/or search agents provided by us or other generally available third party web browser; (j) Sending or attempting to send unsolicited messages, including without limitation, promotions or advertisements for products or services, "pyramid schemes", "spam", "chain mail" or "junk mail"; (k) Using or attempting to use the Service or any VIP-HOTSPOT website to send altered, deceptive or false source-identifying information; (l) Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Service or any VIP-HOTSPOT website; (m) Interfering or attempting to interfere with the access of any user, host or network, including without limitation, sending a "virus" to the Service or any VIP-HOTSPOT website, overloading, "flooding," "spamming," "crashing," or "mailbombing" the Service or any VIP-HOTSPOT website; (n) and/or Impersonating or misrepresenting your affiliation with any person or entity; (o) and /or peer to peer file sharing which is illegal and will no be accepted. You will defend, indemnify and hold VIP-HOTSPOT, its affiliates, and their agents harmless against any and all claims, losses, or liability arising under this section 7. The foregoing sentence will survive termination or expiration of the Agreement for any reason.
7.5 Any email facilities, web hosting or other services that involve us providing storage space on oursystems, we may impose limits (which we may vary from time to time) of the storage space we provide to you, in order to ensure the quality of the service to you and to other users. These limits may relate to the physical amount of web-space or the number of mailboxes made available to you, email messages that can be stored and/or the size of any attachments you can send. We may reject or delete material that exceeds the relevant limit.
8- Fair Use Policy (FUP) and internet usage.
8.1 Our service allows you to access the Internet. Use of the Internet is at your own risk and subject to anyapplicable laws. We take no responsibility for any goods, services, information, software, or other materials you obtain when using the Internet.
8.2 The Internet service is a shared service and the activities of some users can impact the servicesavailable to other users. In an ideal environment, all users would obtain an equal percentage of the available bandwidth. Unfortunately, some users take a disproportionately greater share of the available bandwidth and, as a consequence, other users suffer a diminished service. Particularly at peak times, data rates may reduce by contention within the VIP-HOTSPOT network and the public Internet.
8.3 In order to preserve the quality of our network a Fair Use Policy is in effective as of the 1st of April2008. This policy is intended to assure that users of excessive bandwidth-consuming applications do not disrupt the service of other users on the VIP-HOTSPOT network.
8.4 In order to implement our FUP, we constantly monitor our network and its performance and mayrestrict the amount of service available to users that consume large amounts of bandwidth or download large amounts of data continuously; this is to ensure a fair allocation of bandwidth to all customers.
8.5 As a rule of thumb, if a user does not exceed 3 Giga byte of data download per month as a normal user or 6 Giga byte per month as a mutiuser (heavy user) then they will not be flagged for monitoring. If you do not use Peer-to-Peer or file sharing software (which is illegal) or if you do not download large amounts of data continuously then it is unlikely you will be affected by the FUP policy.

9- Suspension of service / breach of contract:
We can suspend the service or end this contract at any time and no refund or compensation will be granted:
(a) With immediate effect if you materially breach this contract.
(b) With immediate effect if we establish that the service is being used in a way described in section 7.
(c) Upon reasonable notice, if you breach this contract under section 8 and in any other way and fail to remedy the breach within a reasonable period of being asked to do so;
(d) With immediate effect if bankruptcy or insolvency proceedings are brought against you, or an arrangement with creditors is made, or a receiver or an administrator is appointed over any of your assets, or you go into liquidation.
(e) With immediate effect if we have already terminated your use of any service previously as a result of any of the above items.
(f) If we decide to suspend the service, any username or password or access will be terminated by admin.
(g) If we decide to suspend the service under section 9, this contract will continue during the period of suspension and you will be responsible for payments of any and all relevant charges.
11- Matters beyond our reasonable control
11.1Signal strength and coverage area will vary according to terrain, surroundings, weather conditions and client equipment. All coverage areas listed are presented as a guide only. VIP-HOTSPOT will not refund payments for credit bought through the splash page where signal strength is marginal or fault of client equipment.
11.2 If we cannot comply with our promise in this contract due to something beyond our reasonable control including and without limitation, industrial disputes involving our employees, we will not be liable for this. If the events continue for more than three months, we can terminate this contract immediately. Please see section 13 for your right to end this contract.
12- Our liability to you
We have no liability (whether in negligence or otherwise) for any loss not reasonably foreseeableby us when this contract starts, nor any loss of opportunity, goodwill, reputation, business, revenue, profit, or savings you expected to make, wasted expenditure or data being lost or corrupted.
We do not have liability of any sort (including liability for negligence) for the acts or omissions ofother providers of telecommunication services or for faults in or failures of their networks and equipment.
Each provision of this section 12 operates separately in itself and survives independently of the others.
13- Ending this contract
This contract can be ended by:
(a) Us giving one month's notice to you; at your registered contact email or
(b) Giving one day's notice to us to our registered contact point displayed at www.vip-hotspot.com
(c) With no possibility of refund or compensation, should you verbally or physically assault a member of staff employed at the company VIP-HOTSPOT S.L.
14- Changes to this contract
We reserve the right to make any changes to this contract and pricing at any time.
15- How to give notice
As all subscriptions automatically terminate after a predefined time limit, no notice is required byeither party. No refunds will be given for unused time.
You are responsible for checking the mail sent to the email address provided to you as part of theservice.
16- Waiver
None of the parties to this contract shall be considered to have waived any right under this contract because of failure or delay in exercising that right.
17- Third party rights
A person who is not a party to this contract has no right to enforce any term of this contract but this does not affect any right or remedy of a third party which exists or is available apart from the applicable laws.
18- The law that relates to this contract
Spanish Law governs this contract and we both agree to the exclusive jurisdiction of the Spanish approved courts.
19- Speeds
All listed download speeds quoted are measured within the VIP-HOTSPOT network.
1 - Guarantee is void if the equipment is opened or tampered with by a non VIP-HOTSPOT technician. Please note that it is illegal to access or change the settings on any installed equipment connected to the VIP-HOTSPOT network.
2 - VIP-HOTSPOT S.L. does not accept the return or refund of any equipment after it has been installed.
3 - If you, as a customer, cancel your order for whatever reason, deposits will not be returned.
4 - Should said cancellation occur with less than 24 hours notice, an extra charge of €50 will be incurred.
5 - If VIP-HOTSPOT S.L. cancels your order deposits will be returned within 8 days.
6 - Signal strength and coverage areas will vary according to terrain, surroundings and weather conditions, although VIP-HOTSPOT will endeavour to provide the best service possible to their clients. VIP-HOTSPOT cannot be held responsible for factors outside of their control.
7 - VIP-HOTSPOT S.L. can not be held responsible for variations in prices or printing mistakes.
8 - Home installation equipment is guaranteed for 12 months from date of installation.
9 - Please keep this document as proof of installation date.
10 - In the case that installation at your property is unsuccessful, deposits of €50 will be retained by VIP-HOTSPOT to cover the expenses of travel and labour with regards to the site survey carried out.

Monday – Friday: minimum charge €50.00 (1-hour labour + travel); €25.00 per 30-mins thereafter.
Saturday: minimum charge €75.00 (1-hour labour + travel); €37.50 per 30-mins thereafter.
Sunday: minimum charge €100.00 (1-hour labour + travel); €50.00 per 30-mins thereafter.
The above rates include the cost of the technicians travel expenses.
